Lawyers refuse to defend Delhi gang-rape accused

NEW DELHI: Lawyers at a court, hearing the case of a fatal gang-rape which has shocked the nation on Wednesday said they would refuse to defend the men accused of taking part in the assault and murder.

Hearings are expected to begin on Thursday at theSaket district court in New Delhi, where police will formally present a 1,000-page charge sheet against the six-person gang.

“We have decided that no lawyer will stand up to defend the rape accused as it would be immoral to defend the case,” Sanjay Kumar, a lawyer and a member of the Saket District Bar Council, said.

Kumar said the 2,500 advocates registered at the court have decided to “stay away” to ensure “speedy justice”, meaning the government would have to appoint lawyers for the defendants. Another lawyer at the court confirmed the boycott.

Five men are expected to face charges including rape, murder and kidnapping in the Saket court, with the prosecutor likely to seek the death sentence.

A sixth suspect is believed to be 17 years old, meaning he would be tried in a juveniles’ court, but police are conducting bone tests to determine his age.

The brutality and horrific nature of the attack on a 23-year-old has led to protests in the capital and elsewhere over the widespread abuse of women and sex crime.

The rape victim died at the weekend after 13-day struggle to survive injuries so grievous that part of her intestines had to be removed

Women to go black top to bottom today

Continuing with the relentless protests against the gang rape of a medical student in Delhi, women in the national capital will observe Kaala Divas today. “We will wear black top to bottom on Thursday. We will display the voice of protest on black placards. All those participating will also take an off from office,” said Shruti Kolhi, editor of petticoatjournal.com, which is spearheading the campaign.

Protesters will assemble at Jantar Mantar and march towards India Gate. “However, we haven’t got permission to go to India Gate. If we fail to get it, we will protest all day at Jantar Mantar,” said Delhi-based lawyer Sonia Raina.

Having spread the message through social media, Kohli says women from across the country have confirmed their participation in this unique form of protest. Several institutions have cancelled exams in view of Kaala Divas. The Visvesvaraya Technological University and the Karnataka Secondary Education Examination Board have postponed exams scheduled for January 3. The Calcutta University, Madras University and Karnataka University have promised active participation.

There are plans to take the protest further. Kolhi plans to start her community outreach programme in urban villages from Friday. “We need to admonish eve-teasers publicly and whenever a girl does that, others should support her. This is my idea of taking the protests ahead,” said Alka Priyadarshini, a Delhi-based professional.

Delhi gang rape: CJI Altamas Kabir calls for speedy trial of case

NEW DELHI: A fast-track court to try sexual offence cases against women was inaugurated here by Chief Justice of India Altamas Kabir on Wednesday who advocated speedy trial of the case relating to the December 16 gang-rape of the 23-year-old girl who later died of injuries sustained .

The CJI, who justified the public reaction against the ghastly incident, said the offence could have been averted had the Supreme Court guidelines on removal of tinted glasses from the vehicles been followed.

“It’s good to know that after the December 16 tragic incident, people have started raising their voice on crime against women,” he said while expressing the hope that the fast track court at Saket district courts complex here would be operational immediately.

The CJI, however, said blame game should be avoided and the case of the paramedic, which is in the “public eye”, should be decided on fast track.

“Blame game will not serve anything. We have to go to the root of the problem. This case, which is in the public eye, should be decided as early as possible,” he said.

He also cautioned about the people’s reaction against sending the accused for trial and calling for handing them over to the public to be dealt with by saying that it is a “dangerous reaction”.

“People’s reaction has been that do not send the accused to trial. Hand them over to us, we will deal with them. Hang them. But let us not get carried away. Let us deal with the matter in a manner in which we are able to do justice as early as possible. Let us show that the judiciary is behind the common man,” he said.

The CJI said a fast track court particularly for trying sexual offences against women was not only necessary but also welcome and the government has also “woken up” to the need of fast track courts for such cases.

The CJI said he will try his level best with the administration to see that the other part of the case, that is the part before the matter comes to the court, is taken care of as quickly as possible.

Justice Kabir said four other fast track courts would be made operational in different parts of Delhi to show “we mean business in tackling matters of such nature”.

Chief justice of the Delhi high court D Murugesan said judicial officers have been identified for the fast track courts and wherever possible, cases will be taken up on a day-to-day basis.

Apart from the CJI and the chief justice of the Delhi high court, several judges of the high court and district courts were also present at the inauguration ceremony.

Delhi gang-rape: Declare 2013 as ‘year of women’s safety’, CPI(M) MP to PM

THIRUVANANTHAPURAM: CPI(M) leader and Rajya Sabha member T N Seema on Monday urged the Union government to declare 2013 as “Year of Women’s Safety” as a homage to the Delhi gangrape victim, who braved the brutal assault and fought for life till her last breath.

In a statement here, Seema also urged every citizen of the country, especially women, to skip New Year celebrations to express solidarity with the family of the victim and to support the cause of the innumerable rape victims in the country.

“I make a strong request to Prime Minister Manmohan Singh that let the year 2013 be observed as the Year for Women’s Safety. We all should pledge to wear black clothes tomorrow as a mark of homage to the brave girl and protest against such happenings,” she said.

Seema, also leader of CPI-M’s women wing AIDWA, appealed to women from all walks of life to gherao District Collectors, Superintendents of Police, Chief Ministers and Ministers across the country demanding immediate changes in the existing framework of law to prevent such happenings in future.

Stating that women’s safety could be ensured only through strong partnerships between civil society organisations, governments, urban authorities and law-enforcing agencies, she said political parties, corporates and media should essentially declare their gender policy.

New training standards for policemen should be evolved and the National Commission for Women should be professionalised to initiate strong action against culprits in the cases of violence against women, she said.

She also demanded immediate removal of inefficient and ineffective members from the women’s panel and asked the Commission to maintain a record about what happens to rape cases from prevention to investigation to conviction.

Draft chargesheet in Delhi gang-rape case ready: Sources

New Delhi: The draft chargesheet in the brutal gang-rape of the 23-year old girl who died in Singapore has been prepared and the police in all liklihood will seek maximum punishment for the rapists, according to sources on Monday.

Delhi Police have sited 30 witnesses in the chargesheet and will ensure a fast trial in the case. As per reports, the chargesheet will be filed on January 03 in city’s Saket court. The convicts will be charged under Section 302 of the Indian Penal Code .

The chargesheet is said to be of about 1000-page.

After the girl’s death, the charges of murder were added in the chargesheet against the six accused men.

All six accused have already been charged with gang-rape, kidnapping, unnatural offences, hurting in committing robbery and common intention under the Indian Penal Code.

In the wake of the death of Delhi gang rape victim, the movement demanding justice for 23-year-old medical student and better security for women continued across the country.

Activists and various student groups have vowed to keep the movement alive.

The BJP too organised a condolence meeting at Jantar Mantar today to pay tribute to the 23-year-old gang rape victim.

Top BJP leaders including LK Advani, Arun Jaitley and Sushma Swaraj offered tribute the brave heart, who died after battling for life for 13 days.

Following a day of protests on Sunday across India over the brutal rape and killing, several cities held silent candle light vigils to remember the young woman.

In New Delhi, where the attack took place, a petition calling for the death penalty for rape gathered 100,000 signatures.

New Delhi has the highest number of sex crimes among India’s major cities, with a rape reported on average every 18 hours, police figures show. Reported rape cases rose by nearly 17 percent between 2007 and 2011, according to government data.

I still remember mom when once you and dad asked me what I need to do in my life I replied you I will reduce the pain of other’s people and I became a physiotherapist so that I can try my level best to reduce the pain of others. But today I am not able to resist my own pain.

Doctors are slashing my body parts for the fifth time like they were never the parts of my body…it is paining a lot mom I am not able to breathe properly and they attached me with oxygen cap. please tell the doctors not to give me the anesthesia mom.

I am scared I don’t want to close my eyes. If I close my eyes it takes me to that scary phase of my life where I was being cut into pieces I was just bunch of flesh which was being continuously chopped by those animals. Those faces were very scary mom they were like those hungry animals who were biting at every parts of my body.I don’t have courage to look myself in the mirror. Mom please break all the mirrors nearby me. Pls take me to bath. I want to bath. I want to sit under the shower for years mom so that I can wash those inhuman touch which has made me hate my own body.I tried to go towards bathroom but my stomach pain didn’t allow me to move myself.I can’t raise my head to see you standing outside through door glass.

When someone enter in my room I feel very scared mom. my heartbeats gets faster my eyes searches for you. please be around me. I don’t want to be alone.

Mom these medical instrument beeps are haunting in my brain. they sound like those unhelping traffic sounds which muted my cry and pleads which I was doing that time mom. The silence of this room reminds me of that silence when I was thrown on deserted road. I don’t know what happened but I was feeling very much cold the same way like a person shivering with very high temperature. Mom do you remember once when dad slapped me in childhood how much you fought with him until dad didn’t bring my favorite chocolate…

They have beaten me and my dearest friend with some metal. It was paining a lot mom. I saw how he was bleeding to save me but they were coward rascals. They kept on beating him together till he didn’t collapse and then they scratched every parts of my body repeatedly mom. You always taught me to fight with the difficult situations but I am very weak in this situation. please hold my hand.

‘Amanat’s’ mother collapses during cremation, admitted to hospital

New DelhiUnable to bear the loss of her daughter, the 45-year-old mother of the 23-year-old medical student ‘Amanat’ (NOT her real name) collapsed today and was rushed to a city hospital where doctors said her condition was stable.Image

Doctors at the Deen Dayal Upadhyay Hospital in west Delhi said the woman underwent thorough check-ups and was doing “completely fine” now.

A senior doctor said she was suffering from grief and that is why she was unconscious for some time in the morning after the cremation.
He said the woman was frail and was not able to bear the loss of her daughter. “It also looks like she had not had proper food for the past 10-12 days and is very weak. We call it the grief effect,” the doctor said. 

The doctor said she must have been anxious and disturbed for the past couple of weeks and this was the reason for her collapse. 

She is under the observation of doctors.

5 CHANGES NEEDED IN OUR LAWS

1.Increase the deterrence against crimes against women. Change law to make life term plus chemical castration the punishment for violent rapes                                                                        2. Expand the definition of rape to include not just penile penetration of the vagina but also oral sex and penetration for sexual purpose of the vagina, anus, urethra or mouth                                     3. Introduce rape by security forces as a special category of aggravated sexual assault on the lines of the clause dealing with custodial rape                                                                                   4. Enhance the maximum prison term for molestation from 2 to 5 years & sexual harassment or what’s euphemistically called ‘eve-teasing’ from 1 to 3 years                                                           5. Remove gender inequities in the provisions relating adultery and natural guardian and enact a special law to take pre-emptive action against caste assemblies inciting “honour killings”

5 STEPS TO ENHANCE WOMEN’S SAFETY

1. Increase police patrolling. If necessary, hike number of cops in city. All VIPs with more than two security personnel should give one cop from their security to enhance police presence for the public                                                                                                                                                      2. Register FIRs in all cases of rape, sexual harassment and other crimes against women. Prosecute cops found persuading women to drop such complaints                                                                                                                                                                                                                                   3.Home guards on buses not enough. Institute system of random checking of buses by PCR vans at night                                                                                                                                   4.Use technology: All public transport must be on GPS, install CCTVs on buses, make drivers and helpers/conductors wear non-tamperable photo IDs, create common database accessible by police and other enforcement agencies                                                                                        5.All sexual offenders must be monitored by law enforcers once they have served their sentence

Gangrape victim a martyr for cause of women’s safety: NCW

Calling the 23-year-old gang-rape victim a “martyr” for safety of women, the National Commission for Women (NCW) today asked both civil society and the government to work together to stop such crimes in the future.

NCW chairperson Mamata Sharma said the civil society should also assist the government in amending laws related to sexual assault on women.

“The young girl is martyr in the name of women’s safety. Everyone, the government and the civil society should work together and help in amending laws relating to sexual assault against women,” she said.

It was the duty of everyone to ensure that such incidents do not recur in the future, she said. The paramedic student, who was gang-raped and brutally assaulted by six men in a moving bus on December 16, died “peacefully” at the Mount Elizabeth Hospital in Singapore where she was airlifted on Wednesday night.

Her condition took a turn for the worse last night and she passed away in the wee hours today due to multiple organ failure.
